These Terms of Use (“Terms”) govern your use of this website. The website is operated by Cubre Inc., a Colorado corporation (“Cubre,” “we,” “us”).

By using this website, you agree to these Terms. If you do not agree, please do not use the website.

1. Scope — this page covers the website only

These Terms apply to this website and nothing else. They do not govern use of the Cubre application, and they do not create or modify any agreement between Cubre and a customer of the Cubre application. Access to the Cubre application is governed by a separate written agreement between Cubre and that customer. Nothing on this website is part of that agreement.

2. What this website is

This website exists to describe Cubre’s business and provide a way to contact us. The content here is general information about our software. It is not a contract, an offer, a warranty, or professional advice of any kind.

3. Permitted use

You may read this website and contact us using the address we publish. You agree not to:

  • attempt to gain unauthorized access to the website or any system connected to it;
  • interfere with the operation or availability of the website;
  • use automated means to overload or disrupt the website;
  • use the website to violate any applicable law.

4. Intellectual property

The content of this website — including its text, layout, design, and the Cubre name and logo — is owned by Cubre or used with permission, and is protected by copyright and other laws. You may not copy, reproduce, or reuse it except as permitted by law, without our prior written permission.

5. Text messages

If you hold a Cubre account and turn on phone-based two-step verification, Cubre will text one-time verification codes to the mobile number you enter. That is the only text message Cubre sends you. We send no marketing or promotional text messages.

  • Message frequency: only when you enroll a phone or sign in. There is no recurring message.
  • Cost: message and data rates may apply. Cubre does not charge you for these messages.
  • To stop: reply STOP to any message. For help, reply HELP or email support@cubre.app.
  • If you stop them: these messages are sign-in codes, so you will need to use another verification method — a code sent to your email address, or a backup code from enrollment.
  • Your mobile information is never sold or shared with third parties or affiliates for their marketing or promotional purposes. See the Privacy Policy.

Messages that a contracting business sends to its own customers through Cubre are sent by that business, under its own consent and opt-out arrangements. Cubre is not the sender of those messages and this section does not govern them.

6. Accuracy and availability

We work to keep this website accurate and available, but we do not promise that it will be error-free, complete, current, or uninterrupted. We may change, suspend, or remove any part of this website at any time without notice.

This website may link to sites we do not control. We are not responsible for the content, policies, or practices of those sites. A link is not an endorsement.

8. Disclaimer of warranties

This website is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Cubre will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or relating to your use of this website. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

We may update these Terms. The version posted on this page is the version in effect, and the “last updated” date above reflects when it changed. Continuing to use the website after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute arising out of these Terms or this website will be brought in the state or federal courts located in Colorado, and you consent to their jurisdiction.
